Terms of Service

1. Acceptance of terms
By accessing or using Appointy Cloud ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. Description of service
Appointy Cloud is a multi-tenant booking and appointment management platform. We provide tools for businesses to create booking pages, manage appointments, and communicate with customers. The Platform is provided on an "as is" and "as available" basis.
3. Account registration
To use the Platform as a business owner, you must provide accurate and complete information during registration. You are responsible for maintaining the security of your account and for all activities that occur under your account.
4. Acceptable use
You agree not to:
- Use the Platform for any unlawful purpose
- Attempt to gain unauthorised access to other accounts or systems
- Transmit malicious code, spam, or harmful content
- Interfere with the operation of the Platform
- Scrape, harvest, or collect data from the Platform without permission
- Impersonate any person or entity
5. Pricing and billing
The Platform offers free and paid plans. Paid plans are billed monthly or annually via Stripe. Prices may change with 30 days' notice. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
6. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPOINTY CLOUD, ITS OWNERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or business opportunity
- Loss of goodwill or reputation
- Cost of procuring substitute services
- Any damages arising from missed, cancelled, or incorrectly scheduled appointments
- Any damages arising from service interruptions, bugs, or errors
- Any damages arising from the actions or omissions of tenant businesses or their customers
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) £0 (ZERO POUNDS STERLING).
You acknowledge that the Platform is provided free or at low cost and that this limitation of liability is a fundamental term of the agreement without which we would not provide the service.
7. Disclaimer of warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content, data, or information provided through the Platform.
8. Indemnification
You agree to indemnify and hold harmless Appointy Cloud and its owners, directors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.
9. Tenant responsibility
Tenant businesses are solely responsible for the accuracy of their service listings, pricing, availability, and all communications with their customers. Appointy Cloud acts as a technology platform only and is not a party to any agreement between a Tenant and their customer.
10. Data and privacy
Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference.
11. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections 6, 7, 8, and 12 survive termination.
12. Governing law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to terms
We may modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms. Material changes will be notified via email or prominent notice on the Platform.
